Are Australia`s Refugee Policies Compliant With International Agreements
The obligation of non-refoulement under the CAT is provided for in Article 3, which provides that the Guidelines on Strategies and Procedures for the Management of Unaccompanied Children Seeking Asylum (1997) (UNAM UNHCR Guidelines) and the Declaration on Good Practices of the Separated Children in Europe Programme (2000) (which was a joint effort of UNHCR and Save the Children) are specifically focused on the protection of children, Who have been separated from their families. These include specific measures to address the increased vulnerability of children who do not have the support of their parents. They also constitute a convincing interpretation of the application of the Convention relating to the Status of Refugees to all children and clearly refer to the provisions of the CRC. Refugee law is a politically pragmatic way of reconciling states` general commitment to selfish control of immigration with the reality of forced migration. . . .
